Facts:
After a bench
trial in the Circuit Court of Richmond (Virginia), defendant was convicted of
two counts of involuntary manslaughter, one count of leaving the scene of an
accident in violation of Va. Code Ann. § 46.2-894, and one count of driving
under the influence. On appeal, defendant argued that the evidence was
insufficient to sustain his convictions of involuntary manslaughter and leaving
the scene of an accident.

Court made the following holding:
- To sustain a conviction
of involuntary manslaughter under Virginia law, the Commonwealth is
required to prove that the defendant committed acts of commission or
omission of a wanton or wilful nature, showing a reckless or indifferent
disregard of the rights of others, under circumstances reasonably calculated
to produce injury, or which make it not improbable that injury will be
occasioned, and the offender knows, or is charged with the knowledge of,
the probable result of his acts. The Commonwealth must also prove that the
defendant's criminally negligent acts were a proximate cause of the
victim's death.
- It is the flight from
the scene, and the failure to give the information required to the person
in charge of the property damaged or succor to the injured which
constitute the completed offense under Va. Code Ann. § 46.2-894. The duty
imposed upon the driver of a vehicle involved in an accident is not
passive. It requires positive, affirmative action--that is, to stop and
give the aid and information specified.
